Psychiatric examination in assessing accountability

Psychiatric examination with respect to the assessment of culpability asks the question to what extent mental disorders play a role in an employee's presumed incapacity. In that case, the - degree of - imputability is asked. This can be relevant in, for example, dismissal procedures, objection cases or when assessing dereliction of official duty. Our psychiatrists are able to provide clear and substantiated answers to such questions.

Reports may be requested either by the employer or by the individual or the individual's authorized representative.

How does a Psychiatric examination proceed in the context of assessing imputability?

Application

Once the request for Psychiatric examination regarding the assessment of culpability is received by us, we will contact the individual within one business day to schedule the examination. The examination will then take place within 3 to 4 weeks.

The examination

A Psychiatric examination in the context of assessing culpability involves two interviews. The first interview takes place with a psychologist, the second with a psychiatrist. It may also be necessary to request additional information from practitioners. The examination takes place in accordance with the most current guidelines of the Dutch Psychiatric Association and the Royal Dutch Medical Association (KNMG).

The report

The findings are presented in a report. This is sent to the person requesting If the applicant is not a physician, the report will not be sent to the applicant but to the physician listed in the request form.

Information on progress

Our secretariat can inform you about the progress of the examination at any time.

Right of inspection and correction

The report is subject to the right of inspection and correction. This means that the person concerned receives a copy of the draft report before sending it to the applicant and can indicate whether it contains an incorrect representation of facts.
